Comparison between FIDIC and NECForm for Turnkey Mode of Contracting

Abstract

Various contractual forms have been used in India to execute large infrastructure projects. These forms carry risk on account of the clauses unknown, complexity of understanding and the legality of language. Amongst the various existing forms most international projects In India are executed using the FIDIC or NEC form of contract. This work tries to analyse both these forms of contracts for turnkey mode of contracting and elaborate on the risks carried by each of them from the various included clauses.
